Мобілізація в Україні: роботодавець може вручати повістки своїм підлеглим, але є нюанс

Про Який порядок вручення повісток на роботі за новими правилами.

В Україні згідно з новими правилами обліку за Постановою № 1487 “Про затвердження Порядку організації та ведення військового обліку призовників, військовозобов’язаних та резервістів”, в 2023 році роботодавці не лише мають здійснювати військовий облік працівників, прийняти на роботу або навчання військовозобов’язану особу можуть лише після взяття його на військовий облік. А жінок, які навчаються на медичних спеціальностях, беруть на військовий облік на останньому курсу навчання.

Про це йдеться у відповідній Постанові.

Роботодавці також зобов’язані подавати до ТЦК комплектування та повідомляти про взяття на роботу та звільнення співробітників, а також надавати інформацію про них, поки вони праціюють у компанії.

Роботодавець може повідомляти та вручати повістки своїм підлеглим, але лише якщо отримав відповідне розпорядження від начальника ТЦК.

Діє низка правил вручення повісток на роботі та оповіщення:

видати наказ (розпорядження) про оповіщення ПВР, довести його до відома таких осіб під особистий підпис та надіслати копію наказу (розпорядження) у триденний строк до відповідного ТЦК;
вручити ПВР повістки про явку за викликом до ТЦК;
письмово повідомити з наданням витягів з наказів (розпоряджень) відповідним ТЦК про осіб з числа ПВР, які тимчасово непрацездатні, перебувають у відпустці або у відрядженні;
забезпечити здійснення контролю за результатами оповіщення та прибуттям ПВР до відповідного ТЦК
Також, як повідомляє видання NV із посиланням на пояснення юристів, передбачено можливість здійснення перевірок стану організації та ведення бізнесом військового обліку ПВР.

Зазначимо, що вручити повістку може представник ОСББ або ЖКГ. Юрист пояснив, що крім представників центру комплектування, повістки можуть вручати як органи місцевого самоврядування, так і представники експлуатаційних компаній чи ОСББ.

Раніше повідомлялося, що чоловіків призовного віку, які перебували за кордоном, можуть притягнути до адмінвідповідальності після повернення до України.
