Два місяці ТЦК не повинні затримувати українців
Після набуття чинності новим законом про мобілізацію у військовозобов’язаних громадян є два місяці, щоб оновити дані до ТЦК та СП. Але, як стверджує член Комісії з правової реформи при Президентові України Олександр Павличенко, у цей час представники ТЦК не мають підстав для затримання та доставки чоловіків до територіальних центрів комплектування, пише телеграм-канал Батальйон “Монако”.

Олександр Павличенко прокоментував примусову доставку українців до ТЦК для оновлення військово-облікових даних, які зараз масово застосовуються до військовозобов’язаних чоловіків. Для такого формату залучення громадян до виконання правил військового обліку представники ТЦК не мають підстави.

“Наразі немає підстав, щоб особу припроваджувати, наприклад, примусово для проведення звірки цих персональних даних до закінчення цього терміну двох місяців”, – заявив член Комісії з правової реформи.

Окрім цього, Олександр Павличенко пояснив, що це не скасовує повноважень ТЦК на вручення повісток, щоби військовозобов’язані українці з’явилися в ТЦК для уточнення персональних даних.

“Вони можуть тільки вручити повістку на звірку цих персональних даних, це може статися, тоді у людини буде певний, конкретніший термін. Але це, так би мовити, здвоєння, дублювання двох процедур, бо одна процедура передбачена законом, ці 60 днів, інша процедура – ​​це коли особа отримує повістку”, – зазначив Олександр Павліченко.

Також він нагадав, що українці можуть отримувати кілька видів повісток, передбачених для різних видів виконання обов’язків українців під час дії воєнного стану.

“Нагадаю, що є три варіанти повістки. Це – порядок денний для звірки персональних даних, другий – для проходження ВЛК, і третій – це так званий мобілізаційний порядок денний або бойовий порядок денний, який видається для того, щоб особа вже була мобілізована”, – сказав Олександр. Павліченко.
