Два випадки виплати аліментів після 18 років
У Сімейному кодексі України (СКУ) ст. ст. 180, 181 СКУ чітко сказано: один з батьків, який проживає окремо від сім’ї, утримує дитину, поки вона досягне повноліття. Однак сьогодні є два випадки, коли аліменти отримують і діти після 18 років:
1) батьки матеріально утримують дитину після досягнення нею 18-річчя в разі непрацездатності або iнвaлiднoсті. У такому випадку за матеріальне утримання дитини відповідають обидва батьки: вони платять аліменти в рівному розмірі (ст.198 СКУ);
2) якщо дитина, яка досягла 18 років, проходить навчання у вищому навчальному закладі (денна форма). В такому випадку батькам покладається допомагати дитині матеріально в формі аліментів до тих пір, поки дитина не завершить своє навчання у вузі і не досягне віку 23 років (ст.199).
Зрозуміло, ці статті СКУ можуть бути реалізовані тільки, якщо батьки можуть надавати дитині матеріальну підтримку.
ВАЖЛИВО. Виплата аліментів може бути припинена, коли дитині виповнюється 23 роки, а також якщо вона кинула навчання або перейшла на заочну форму навчання.
Як витребувати аліменти після 18 років
Чи варто говорити, що в житті далеко не все так гладко як в кодексі, і часто хтось із подружжя відмовляється виплачувати аліменти на дитину, якій вже є 18. Як бути в такому випадку? Захистити право студента на матеріальну підтримку доведеться одному з його батьків: за допомогою сімейного адвоката до суду направляють позовну заяву з вимогою виплати аліментів для повнолітньої дитини.
ВАЖЛИВО. Аліменти на дитину, яка досягла 18-ти років, оформляються в тій же формі, що і виплати на дитину до повноліття: тобто в чітко регламентованій відсотковій частці від доходу (відрахувань) або в конкретній грошовій сумі. У суді можуть призначити виплату у твердій сумі, якщо у когось з батьків повнолітньої дитини немає постійного місця роботи і, відповідно, постійного доходу.
