Тепер лише позбавлення прав: нардепи вигадали новий закон для водіїв

До Ради внесли закон, тепер водіїв позбавлятимуть прав
В Україні планують посилити покарання за порушення правил безпеки дорожнього руху, що спричинило загибель людей. Відповідний законопроект №11429 про внесення змін до статті 286 Кримінального кодексу України щодо застосування додаткового виду покарання зареєстрували цього тижня у Верховній Раді. Про це йдеться у Телеграм-каналі “Автомобіліст”.

У проекті закону пропонується внести зміни до частини другої та третьої статті 286 Кримінального кодексу України щодо встановлення обов’язкового застосування додаткового покарання у вигляді позбавлення на визначений термін права керувати транспортними засобами винних осіб.

Законопроект передбачає, якщо водій завдав ДТП, в якій загинув потерпілий або йому заподіяно тяжке тілесне ушкодження, він може потрапити до в’язниці на строк від 3 до 8 років з позбавленням права керувати транспортними засобами від 3 до 5 років. Зараз УКУ передбачає позбавлення права керувати автомобілем максимум на 3 роки, або ж суд може взагалі не призначати це додаткове покарання.

У законопроекті №11429 також пропонується у разі, якщо з вини водія в ДТП загинули кілька людей, то він крім 5-10 років в’язниці має бути обов’язково позбавлений права керувати транспортними засобами на строк від 5 до 8 років. Наразі УКУ передбачає до 3-х років позбавлення права управління.

«На жаль, на практиці судові інстанції, розглядаючи кримінальні справи за статтею 286 Кримінального кодексу, нерідко ухвалюють вирок без призначення додаткового покарання у вигляді позбавлення права керувати транспортними засобами. При пересуванні до певного пункту призначення за кермом власного транспортного засобу», – зазначено в записці пояснення до законопроекту.

Обґрунтовуючи необхідність ухвалення законопроекту, його автори посилаються на статистику департаменту патрульної поліції щодо ДТП із постраждалими в Україні за 2023 рік. За даними поліції, протягом 2023 року в Україні сталося 23642 аварії із загиблими та травмованими, що на 26,9% більше, ніж у 2022 році, коли сталося 18628 ДТП.
